PUBLIC OFFER
of Charitable Contribution/Donation
This Public Offer for Charitable Donations (hereinafter referred to as the Offer) is aimed at an indefinite number of individuals (hereinafter referred to as the Benefactor) who visit the official website of the Charitable Foundation “Safe Country” hereinafter referred to as the (Foundation on the Internet at https://www.safecountry.org.ua/ (hereinafter – the Website), represented by the founders Oleksiuk Oleksii Ihorovych and Kholodylo Ihor Fedorovych acting based on the Statute, to enter into a charitable donation agreement (hereinafter – the Agreement), the essence of which is set out below.
1. Definitions and Concepts
1.1. Public offer is a valid offer of the Foundation, posted on the Website, to provide a charitable donation, addressed to an unlimited number of persons, including the Benefactor.
1.2. Acceptance is the full and unconditional acceptance of the Public Offer by committing actions to make a money transfer using payment forms and funds posted on the Website, as well as by transferring funds to the current account of the Foundation through banking institutions. The moment of Acceptance is the date of crediting the funds to the bank settlement account of the Foundation.
1.3. Charitable donation is a free transfer of funds ownership by the Benefactor to the Foundation to achieve certain, predetermined goals of the activity, in accordance with the Agreement and the Law of Ukraine “On Charitable Activities and Charitable Organizations”.
1.4. Payment is a voluntary charitable donation.
2. Subject of the Agreement:
2.1. The subject of this Agreement is a free and voluntary transfer of funds from the Benefactor to the Foundation, by making voluntary donations to achieve the statutory goals and activities of the Foundation.
2.2. Acceptance of the Offer (acceptance of the terms of the Offer) means that the Benefactor agrees with all its provisions; he/she is acquainted with the Statute of the Foundation, and he/she is fully aware of and agrees with the subject of the Agreement.
2.3. By concluding the Agreement, the Benefactor joins the Agreement unconditionally and fully and accepts all the essential provisions of the Offer.
2.4. The Benefactor and the Foundation, guided by Art. 207, Part 2 of Art. 639, Art. 641 and 642 of the Civil Code of Ukraine, and Art.7 of the Law of Ukraine “On Charitable Activities and Charitable Organizations”, agree that the Agreement is considered to be concluded in the writing from the moment the Benefactor takes the actions stipulated by the Agreement, which indicate his agreement to comply with the terms of the Agreement.
2.5. The agreement is available at https://www.safecountry.org.ua/ for free access and in a way that ensures familiarization with the content of this Agreement for every person who applies to the Charity Foundation.
2.6. The Benefactor shall not offer his/her terms of the Agreement
3. Rights and Responsibilities of the Parties:
3.1. Charitable Foundation has the right to:
- Receive Charitable Donations and use them for the Statutory activities of the Foundation. in accordance with the Agreement the Law of Ukraine “On Charitable Activities and Charitable Organizations.”
- Provide Reports on the receipt and use of charitable donations at the request of the Benefactor.
3.2. The Benefactor has the right to:
- Transfer the voluntary charitable donation to the account of the Foundation in the manner specified in the Agreement;
- Contact the Foundation for a report on the use of charitable donations by the Foundation.
4. Place of receiving charitable donations:
Public collection of donations is carried out on the territory of any country in the world.
5. Terms of receiving charitable donations:
5.1. In case of non-implementation of the project or in the presence of balances, the funds will go to support other projects of the fund.The amount of the donation is non-refundable. By making a charitable donation, you agree to the above terms.
6. The access to the reports on the use of charitable donations
6.1. The access to the reports of the Charitable Foundation is provided by publishing them on the website of the Foundation in the section “Reports.”
6.2. Other information is provided by the Foundation in the manner and within the time limits defined by the current legislation of Ukraine.
7. All expenses for payment of amounts (commissions, fees, taxes, etc.) related to the transfer and crediting of a charitable donation shall be borne by the Benefactor.
8. Other Terms
8.1. Benefactor defines the amount of the voluntary charitable donation at his/her own discretion.
8.2. The donation is voluntary and non-refundable.
8.3. Benefactor is responsible for the accuracy of the information provided when transferring voluntary charitable donations.
8.4. In accordance with the Law of Ukraine “On Personal Data Protection” and the terms of this Agreement, Benefactor confirms that he is familiar with and agrees to the collection and processing of personal data.
8.5. The relations between the Parties (Benefactor and Charitable Foundation) are guided by the current legislation of Ukraine.
